The rule, and the screen that meets it

We cite the rule so you can check it yourself. This page is information, not legal advice.

Read the four texting rows carefully. That logic is written and can be watched working, but it runs in simulation only. Tessavio cannot send a text message today. Rows marked simulated describe what the software does on screen, not messages arriving on anyone’s phone.

RuleWhat it requires, in shortWhat Tessavio does
N.J.A.C. 13:30-8.7(c)4Treatment record entries are posted at least monthly. A correction is a new entry showing the original, the revised version, the date, the reason and who authorized it.Posts last month's entries by the 8th. After that, changes are only possible as owner-approved corrections, and every correction is listed on the patient's file.
47 CFR 64.1200(a)(10)Patients can stop texts with any reasonable wording, and no single way of revoking can be required.STOP, END, "no more texts" and similar replies opt the number out at once. Unclear replies ("cancel") go to a person to decide instead of guessing. simulated
47 CFR 64.1200(a)(12)One confirmation text may be sent after an opt-out, within five minutes.Sends exactly one confirmation and nothing after it until the patient texts START. simulated
47 CFR 64.1200(a)(9)(iv)Health care texts must name the practice and give a contact number, stay under 160 characters, and carry no marketing.Reminder texts carry your office name and phone and are trimmed to 160 characters. No offers or prices in reminders. simulated
47 CFR 64.1200(f)(9)Marketing texts need prior express written consent with specific disclosures.Review requests and membership notices go only to patients whose signed consent text is on file. simulated
HIPAA (45 CFR 164)A vendor that handles patient information signs a Business Associate Agreement.Tessavio signs a BAA with every practice before any patient information is entered. Every change is kept in an activity log.

What isn’t finished

Texting does not send. The reminder wording, the opt-out handling and the consent checks are written and run in simulation, and that is all they do. There is no connection to a phone carrier, and the software has no setting that would switch one on. Making it real needs a carrier-registered account for your practice and work on my side that has not been scheduled. It is not included in the monthly price and not part of the install. If that changes, this page changes with it.

No practice is using Tessavio yet. Everything here has been tested by the person who wrote it, screen by screen, and by nobody else. The first five practices are how that gets fixed, and the price says so.

If either of those matters to you, ask before you sign, and I’ll put the answer in writing.
